Terms of Service

These Terms of Service ("Terms") govern your access to and use of Pic-A-Gig ("we," "us," or "our"), including our website at picagig.com and any related mobile applications (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and capable of forming a legally binding contract to use the Service. By using the Service, you represent that you meet these requirements. The Service is intended for use in the United States.

2. Account Registration

You must create an account to access most features. You agree to provide accurate, complete, and current information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@picagig.com if you suspect unauthorized access.

3. The Platform — What Pic-A-Gig Does

Pic-A-Gig is a marketplace that connects people who need local jobs done ("Posters") with people who can do them ("Workers"). We are not a party to any agreement between Posters and Workers and do not employ, supervise, or control Workers. We provide the platform, payment escrow, and communication tools only.

6. Independent Contractors

Workers using Pic-A-Gig are independent contractors, not employees, agents, or partners of Pic-A-Gig. Workers are solely responsible for determining the manner and means of completing jobs, paying applicable taxes, and complying with all laws governing their work. Pic-A-Gig does not withhold taxes on behalf of Workers.

7. Ratings and Reviews

Both Posters and Workers may leave ratings and reviews after a job is completed. You agree that any review you submit is honest, accurate, and based on your actual experience. We reserve the right to remove reviews that violate these Terms or our community guidelines.

8. Intellectual Property

All content, branding, logos, and software comprising the Service are owned by Pic-A-Gig or our licensors and protected by applicable intellectual property laws. You may not copy, reproduce, or create derivative works without our express written permission. You retain ownership of content you submit (photos, messages, job descriptions) and grant us a non-exclusive, royalty-free license to use it to operate and improve the Service.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT GUARANTEE THE QUALITY, SAFETY, OR LEGALITY OF JOBS OR USERS ON THE PLATFORM.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PIC-A-GIG AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF $100 OR THE FEES PAID BY YOU TO PIC-A-GIG IN THE 3 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Pic-A-Gig and its affiliates, officers, directors, and employees from any claims, damages, losses, or expenses (including attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your account at any time for any reason, including violation of these Terms, with or without notice. You may delete your account at any time by contacting us. Termination does not affect any rights or obligations that arose before termination.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Delaware under the rules of the American Arbitration Association. You waive the right to participate in a class action lawsuit or class-wide arbitration.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes your acceptance of the revised Terms.
